Terms and Conditions General Kathleen’s-Graphics will carry out work only where an agreement is provided either by email, mail or fax (in writing). Terms can be agreed to via phone but must be approved in writing prior to design initiation. Kathleen’s-Graphics will carry out work only for clients who are 18 years of age or above. A half down payment of an estimated quote is required prior to design initiation. If estimated quote time is less, final payment will be less. If estimated quote looks like it will be exceeded the client will be notified of this and a decision to finalize project in remaining time or additional time will be purchased. All projects with Kathleen's-Graphics are billed on an hourly basis, time billed in 15 minute increments. Graphic Design Graphic designs consist of concept, approval of proof, modifications to completion. As some project tend to take longer than originally quoted due to continued alterations and modifications, all prices quoted are rough estimates. If a project looks to be nearing the end of the allotted time an email will be sent notifying the customer of the situation and plans will be made to either finalize the project in the time allotted or additional time will be purchased for completion. Time is billed at $35 per hour, billed in 15 minute increments. A detailed and itemized invoice is provided for all work.

Website Design
Website design consists of concept, approval of proof, modifications to completion of proof, implementation into html coding, approval of online design, creation of pages and content, implementation of images, navigation, search engine optimization, final approval then upload. The majority of websites can be completed in the time specified for the project however, if a project looks to be nearing the end of the allotted time an email will be sent with an itemized invoice detailing the time spent thus far, notifying the customer of the situation and plans will be made to either finalize the project in the time allotted or additional time will be purchased for completion. Time is billed at $35 per hour, billed in 15 minute increments.

 Whilst every endeavor will be made to ensure that the website and any scripts or programs are free of errors, Kathleen’s-Graphics cannot accept responsibility for any losses incurred due to malfunction after upload or due to server issues or due to your companies customer complaints. If there are any issues that arise with the website functionality after upload, please notify Kathleen’s-Graphics and we will do what we can to rectify the issue in a timely manner. .

The website, graphics and any programming code remain the property of Kathleen’s-Graphics until all outstanding accounts are paid in full.

Kathleen’s-Graphics cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

The client agrees to make available as soon as is reasonably possible to Kathleen’s-Graphics all materials required to complete the site to the agreed standard and within a timely manner. Delays for completion are to be expected if materials are not provided in a timely manner. Kathleen’s-Graphics will not be liable for costs incurred, compensation or loss of earnings due to this failure.

Kathleen’s-Graphics will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner.

A deposit of 50% is required with any standard project before any design work will be carried out and is non-refundable.

Once a website has been designed and completed the final balance of payment is then due in accordance with our payment terms. There are no exceptions to this, i.e If the client decides they no longer want the site, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done. Non payment will result in legal action being taken if necessary. Once full payment is received for a website, it is assumed that the project has been completed to the clients satisfaction and no refunds will be offered.

Compatibility
Kathleen’s-Graphics will endeavor to ensure that any developed/designed site or application will function correctly on the server it is initially installed in and that it will function correctly when viewed with the web browsing software Microsoft Internet Explorer and to an acceptable level with Mozilla browsers. Kathleen’s-Graphics can offer no guarantees of correct function with all browser software as updates and modifications within those browsers can change frequently.

Website Hosting
Kathleen’s-Graphics offers limited hosting options on its server for $35 per year payable prior to year initiation and due 30 days prior to end of year agreement. If client requires his/her own server or for server to include additional items than offered by Kathleen’s Graphics, we can suggest possible hosting companies to consider but can not be held liable for any errors, down time or issues that arrive with such hosting companies.

Payment of Accounts
A deposit is required from any new client before any work is carried out. It is the policy of Kathleen's-Graphics that any outstanding accounts for work carried out by Kathleen’s-Graphics are required to be paid in full, no later than 30 days from the date of the invoice unless prior arrangements with Kathleen’s-Graphics has been made.

Once a deposit is paid and work completed you are obligated to pay the balance of payment in full. We will contact clients via email and telephone to remind them of such payments if they are not received when due. Delinquent bills can be assessed a $25 charge if payment is not received within 10 business days of the due date. If an amount remains delinquent 30 days after its due date, an additional $35 penalty can be added for each month of delinquency.

If accounts are not settled in a timely manner, access to the related website will be denied and web pages removed, we will then pass such cases to the Small Claims Court to pursue payment.  All fees incurred due to collections will be passed along to the client including damages and loss of time incurred due to the collections process.
